150 trees felled on sites zoned

SCMP on Feb 07, 2009 Cheung Chi-fai About 150 trees have been chopped down in Sai Kung on sites that have not yet been approved for housing development, but planning and lands officials said there was little they could do about it. The trees near Nam A village, close to Tai Mong Tsai, were cut down about a month ago, nearby residents said. Most of the felled trees were located on four private sites zoned as green belts, where developers are seeking permission from the Town Planning Board to build small houses. Some of the felled trees were on government land. Michael Lee Siu-fung, conservation officer with WWF Hong Kong, visited the sites yesterday. He said some of the felled trees had a diameter the size of about 1 1/2 men, and that the damage inflicted on the woodland could not be reversed in the short term. He said it was not uncommon for some developers of small houses to jump the gun by cutting down trees or filling in ponds on the proposed sites, before their building applications were approved. Green belts were set up to limit such developments, he said, urging the board to carefully consider any application for developments. James Wong, from community organisation Friends of Sai Kung, urged the board to reject the Sai Kung application. The board is expected to discuss the application next month. A spokeswoman for the Planning Department said the board would consider the application based on its guidelines, which currently target only unauthorised development such as pond filling and illegal dumping. The Lands Department said it could not act over the felled tree on the private sites because they were old agricultural land whose leases excluded any protection for trees. A spokeswoman for the Agriculture, Fisheries and Conservation Department said the illegal felling of trees on government land was being investigated. "We received complaints [about it] in mid-January, and we have sent an officer to inspect the site but could not find who was responsible for the cut," she said. An expatriate resident from a nearby village alleged that the trees were cut down as part of a bigger plan by influential landlords to build about 300 small houses on a large piece of wetland in the vicinity. "This is the last remaining piece of wetland in Sai Kung which is full of natural wildlife like wild boars, barking deer, dragonfly and butterfly," said the resident, who declined to be named. He said other villagers said the landlords planned to build an access road leading to the wetland, which is surrounded by the villages of Nam A, O Tau and Long Keng, where felling of trees had been a problem. He said many concerned residents had objected to the rezoning proposed by the landlords and claimed they had subsequently been targets of intimidation because of their objections.

***本人反對有關申請***
1. 根據本人資料,
南丫村是沒有村長的,
本人質疑有關之丁屋申請人之身份及資格;
是否符合現行之丁屋申請條件,
及是否有權在南丫村申建丁屋.
2. 由大環村至南丫村有一條唯一的交通運輸通道,
但這條路由於有多個路段又窄又多彎,
而且只可單線單程行車,
沒有避車處,
只適宜一般的小型私家車使用,
而窄的位置是經過大環村的村屋(請參看共7張附圖).
如在任何工程期間,
車流量之增加所帶來之噪音及空氣污染亦不能避免,
對大環村的居民直接造成滋擾及損害他們的利益,
亦引致居民對申請安排之不滿,
直接制造居民的磨察及影嚮政府在市民中的信心.
3. 就算可通過有關之申請而順利建屋,
日後南丫村居民之車輛出入經過大環村的村屋,
是長期及永久;
持續的滋擾.
4. 本人於2009年2月6日到南丫村視察,
發現大量樹木倒下,
有的是在這個申請的私人土地之上,
有的是在政府土地之上,
本人不知這些樹木倒下是否人為所造成,
亦不想在沒有任何資料及証據之前去推斷是否與這宗丁屋之申請有關
,
亦希望有關審批這宗丁屋申請之部門及人仕,
查實這些樹木倒下;
的確無任何疑點及絕對與這宗丁屋申請無關,
否則應把申請擱置及取消有關之申請.
不查不問,
只說捉不到人就是沒証據與這宗丁屋申請無關,
這樣的工作態度是不合時宜的!
如果有人報警被賊人入屋爆竊,
但警察到現場前賊人已離開,
你估警察可否說見不到有賊人;
就不是有人入屋爆竊做籍口而不去調查嗎?
5. 就第4點,
如果通過這宗申請,
日後亦會助長有關之非法行為,
立下不良之先例.
6.
有關之申請是位於以往農耕的梯田之上,
而且涉及不少斜坡,
建屋時必須進行大規模的地盆平整工程及開路,
須要廣泛砍伐大量天然原生樹木,
引致水土流失及增加斜坡的危險性,
更會破壞景觀及損毁生態.
7. 規劃署在西貢OZP內己預留有一定足夠之土地規劃作鄉村式發展之用,
符合丁屋申請資格的申請人應先考慮在此範圍內申建丁屋,
而村長亦應可協助申請人解決問題,
以減少工程帶來之環境生態破壞及對其他人造成滋擾,
如果通過有關之申請,
對日後在同一村內及相同情況下之申請,
立下不良及不公平之先例.
8. 申請之項目未符合西貢OZP內之綠化地帶的規劃意向,
根據一般推定,
這個地帶不宜進行發展.
